http://148.210.21.18/ojs/index.php/reij/article/view/6907

Interdiction is the legal figure through which a person with a disability can exercise their rights, through a representative, but it is restrictive, because undermines the full exercise of the rights of people with disabilities, lacerating their independence and decision making, the problem is that, since there are no gradations in it, it completely replaces the rights of the person subject to interdiction, giving total control to his legal representative. It is argued that this figure is clearly detrimental to the rights of people with disabilities, especially when talking about equality, autonomy, freedom in decision-making and independence. The Mexican National Code of Civil and Family Procedures establishes a new procedure for the designation of extraordinary support in the exercise of legal capacity. The objective of this research is to carry out a comparative analysis of the figure of interdiction with the new procedure, using the analogical method and legal hermeneutics. From the review carried out, it can be concluded that the figure of interdiction is outdated and inadequate to address the situations of people with intellectual disabilities in Mexico and that the new procedure for extraordinary support is more in line with the terms of the Convention on the ...
Claudia Patricia González CobosLila Maguregui Alcaraz

http://148.210.21.18/ojs/index.php/reij/article/view/6914

This article analyzes and examines the conceptual and methodological foundations to design and develop the state of the art in legal research with a methodological approach that promotes a deep understanding of the plurality of approaches within this discipline, highlighting its importance for the identification of trends, gaps and doctrinal debates. First, the review of bibliographic sources is addressed with emphasis on the relevance of using current and reference documents to guarantee the theoretical and practical solidity of the research. Likewise, the validity and relevance of the sources is analyzed in a constantly evolving legal context, highlighting the need to adapt the theoretical framework to regulatory and jurisprudential changes. Regarding the methodology, a structured formulation is proposed for the design of the state of the art, which includes the identification, classification and critical analysis of primary and secondary sources. This approach allows us to articulate a solid conceptual framework that guides contemporary legal research. Finally, the main reference sources on legal methodology are explored, contributing to a debate on the plurality of approaches in scientific legal research.
Juan Ramón Pérez Carrillo

http://148.210.21.18/ojs/index.php/reij/article/view/6915

The Judicial Reform published on September 15, 2024 substantially changes how judges are elected in Mexico, since now judges will be elected through popular vote. The election of judges is very controversial among a large part of society and the Mexican political opposition due to the significant intervention of the government in the election, as well as the possible loss of expertise of judges. By using a dogmatic methodology based on the doctrinal contributions of various jurists who have carried out analyses regarding the separation of powers, jurisdictional autonomy, the democratic legitimacy of judges, and their popular election, it is argued that the changes should not be conceptually controversial, since the direct participation of citizens in the election of judges generally guarantees jurisdictional autonomy. However, it is concluded that with the Judicial Reform, doubts remain regarding its execution. Also, there is uncertainty due to the government’s intervention in the election of judges and the lack of requirements to aspire to a jurisdictional position. Consequently, some proposals are presented to address the questions arising from the Judicial Reform, for example, maintaining the popular election only for the positions of judges of the National Supreme Court of Justice, magistrates of the ...
Mario Alberto Herrera Venegas

http://148.210.21.18/ojs/index.php/reij/article/view/6983

The construction of the concept legal personality has derived into a superlative importance for legal science as it represents a legal protection of fundamental rights for individuals, which must support all legal criteria regarding the separation of assets and the corresponding responsibility. Therefore, based upon deductive and historical methods, by using techniques upon analysis of documentation and texts, proof the origin since ancient times in Rome, getting stronger in Middle Ages and in the current century, becoming an essential element for the protection of fundamental rights for persons. Contemporary law has created new actors in commerce such as interest groups (stakeholders), beneficiary controllers, and compliance officers among others, who must respect legal personality as a fundamental pillar of human rights protection. Patrimony’s separation between a shareholder and a company has been achieved precisely upon the recognition of legal personality for both persons and therefore the responsibility that each entity must assume. When this is not respected, the legal personality is disrupted and human rights are likely to be affected. The conclusion reached is that this ancient theoretical construction in effect in contemporary law is a sine qua non element for the protection of fundamental rights for an enterprise,
Juana del Carmen Ramos Juárez
