It is argued that this figure is clearly detrimental to the rights of people with disabilities, especially when talking about equality, autonomy, freedom in decision-making and independence. The Mexican National Code of Civil and Family Procedures establishes a new procedure for the designation of extraordinary support in the exercise of legal capacity. The objective of this research is to carry out a comparative analysis of the figure of interdiction with the new procedure, using the analogical method and legal hermeneutics. First, the review of bibliographic sources is addressed with emphasis on the relevance of using current and reference documents to guarantee the theoretical and practical solidity of the research. Likewise, the validity and relevance of the sources is analyzed in a constantly evolving legal context, highlighting the need to adapt the theoretical framework to regulatory and jurisprudential changes. Regarding the methodology, a structured formulation is proposed for the design of the state of the art, which includes the identification, classification and critical analysis of primary and secondary sources. This approach allows us to articulate a solid conceptual framework that guides contemporary legal research. The election of judges is very controversial among a large part of society and the Mexican political opposition due to the significant intervention of the government in the election, as well as the possible loss of expertise of judges. By using a dogmatic methodology based on the doctrinal contributions of various jurists who have carried out analyses regarding the separation of powers, jurisdictional autonomy, the democratic legitimacy of judges, and their popular election, it is argued that the changes should not be conceptually controversial, since the direct participation of citizens in the election of judges generally guarantees jurisdictional autonomy. However, it is concluded that with the Judicial Reform, doubts remain regarding its execution. Therefore, based upon deductive and historical methods, by using techniques upon analysis of documentation and texts, proof the origin since ancient times in Rome, getting stronger in Middle Ages and in the current century, becoming an essential element for the protection of fundamental rights for persons. Contemporary law has created new actors in commerce such as interest groups (stakeholders), beneficiary controllers, and compliance officers among others, who must respect legal personality as a fundamental pillar of human rights protection. Patrimony’s separation between a shareholder and a company has been achieved precisely upon the recognition of legal personality for both persons and therefore the responsibility that each entity must assume.
